State rules, Dowry Prohibition Officer arrangements, police practice, Family Court jurisdiction

BNS = Bharatiya Nyaya Sanhita, 2023; BNSS = Bharatiya Nagarik Suraksha Sanhita, 2023; BSA = Bharatiya Sakshya Adhiniyam, 2023; DPA = Dowry Prohibition Act, 1961; DV Act = Protection of Women from Domestic Violence Act, 2005; C = संज्ञेय (cognizable); NC = असंज्ञेय (non-cognizable); B = जमानतीय (bailable); NB = गैर-जमानतीय (non-bailable); JMFC = Judicial Magistrate First Class.

कथित conduct की तारीख, exact statutory wording, BNSS First Schedule, Section 173(3), Section 35 और किसी savings issue की जाँच करें।

Magistrate of the First Class द्वारा triable है।

Section 86(a) health को expressly “mental or physical” रूप में शामिल करता है।

DPA की dowry definition के विपरीत Section 86(b) की wording स्वयं यह नहीं कहती कि property demand “in connection with the marriage” होनी चाहिए।

Clause (a) का wilful-conduct limb property या dowry demand की आवश्यकता नहीं रखता। Clause (b) का harassment limb specified unlawful demand for property or valuable security और coercion या demand पूरी न होने से जुड़ा link मांगता है।

BNS Section 80 dowry death से संबंधित है जहाँ महिला की मृत्यु burns, bodily injury या otherwise than under normal circumstances से विवाह के सात वर्ष के भीतर होती है और death से soon before उसे husband या husband के relative द्वारा dowry demand के लिए या उससे जुड़ी cruelty या harassment दी गई हो।

यह husband और “relative of the husband” दोनों पर लागू होता है।

दूसरी ओर, same house में रहना भी उस relative को immunity नहीं देता जिसके against specific conduct supported है।

BNSS First Schedule Section

General power of attorney

Officer in charge, Deputy Superintendent of Police

Statutory language officer in charge

Fact-based chronology police और Court को conduct classify करने देती है। Exact dates उपलब्ध न हों तो invented precision के बजाय honest time ranges और reference events दें।

“Divorce granted” और “all criminal/property proceedings ended” अलग legal events हैं।

Issues के अनुसार marriage certificate या ceremony proof, invitation card, photographs/video, address और cohabitation records, relevant birth records, gift/present lists, jewellery invoices, bank transfers, loan records, demands से जुड़े messages, medical records, police complaints, mediation papers, DV/maintenance/divorce pleadings और orders, तथा settlement drafts या final agreements preserve करें।

Prescriptions, diagnostic reports, emergency records, photographs और follow-up preserve करें।

DV Act statutory right to reside recognise Supreme Court ने Satish Chander Ahuja में “shared household” का meaning address किया और excessively narrow ownership-based approach से हटकर analysis किया।

Income, needs, other maintenance orders

Rajnesh v.

Legal effect argue करने से पहले pleadings, issues, findings, standard of proof और final order compare करें।

Valid settlement में parties, FIR/complaint numbers, offences, maintenance, permanent alimony, stridhan/articles, lawfully settleable child issues, pending cases, divorce steps, payment schedule, withdrawal/quashing cooperation और non-performance के consequences identify होने चाहिए।

Former Section 482 CrPC की Supreme Court jurisprudence suitable predominantly private matrimonial disputes में settlement-based quashing allow करती है, offence की nature और gravity तथा immediate parties से बाहर के interests के अधीन।

उदाहरण के लिए BNS Section 80 dowry death में minimum सात वर्ष और life imprisonment तक punishment है; उसका prosecution private financial adjustment से बाहर public interests engage करता है।

Other personal laws या Special Marriage Act के अपने regimes हैं, इसलिए HMA rule को universal न करें।

Mutual-consent divorce petition और criminal quashing petition अलग proceedings रहती हैं। Settlement drafting में payments, articles return, first/second motion, quashing cooperation और other cases की withdrawal/disposal coordinate करनी चाहिए, बिना किसी party से unlawful act कराए या Court result guarantee किए।

I. दहेज मृत्यु, suicide संबंधी presumptions, inquest procedure और limitation checks

Section 80 वहाँ लागू होता है जहाँ woman की death burns या bodily injury से होती है या marriage के सात वर्ष के भीतर otherwise than under normal circumstances होती है, और यह दिखाया जाए कि death से soon before husband या husband के relative ने उसे dowry demand के लिए या उससे connected cruelty या harassment दी थी।

Seven-year period Section 80 का ingredient है, सभी matrimonial cruelty law की general expiry date नहीं। Death case में supported other offences भी assess करने चाहिए; यह assume न करें कि Section 80 ही only possible charge है।

Scene material, post-mortem records, communications, medical history, marriage-date proof और alleged demands/cruelty का evidence preserve करें।

“Soon before” proximity requirement है, fixed number of days नहीं; continuing Satbir Singh principles को evidence और current BNS/BSA wording पर apply करना चाहिए।
