Police practice में final report, closure report, cancellation report, mistake of fact, mistake of law, civil nature, insufficient evidence, untraced या undetected जैसी expressions और इसी तरह की State-specific classifications प्रयोग की जाती हैं।
Order में meaningful review के लिए पर्याप्त judicial application of mind दिखनी चाहिए।
High Court, district court या State filing practice formatting, affidavit, copy या service requirements prescribe कर सकती है।
Section 223(1) का नया first proviso complaint पर cognizance से पहले accused को hearing opportunity देना mandatory बनाता है, जो former CrPC Section 200 framework से material change है।
BNSS Section 210(1)(b) police report पर cognizance की अनुमति देता है; Section 210(1)(a) offence constitute करने वाले facts की complaint पर cognizance की।
BNSS Section 223 का first proviso expressly complaint पर cognizance को address करता है। केवल complaint proviso import करके police final report की initial consideration में accused का general participation right assert नहीं किया जाना चाहिए।
Magistrate के report पर act करने से पहले superior police officer के statutory supervisory functions हो सकते हैं, और BNSS Section 193(4) State directions से covered cases में specific superior-officer mechanism देता है।
लेकिन closure की acceptance judicial control और proper basis for reopening की आवश्यकता को materially stronger बनाती है।
विशेषकर closure accept होने या substantial time बीत जाने के बाद, केवल ‘truth must be discovered’ जैसी vague assertion reasoned basis का substitute नहीं है।
Proposed step legitimate completion of investigation है या improper lacuna-filling, यह fact-sensitive question है।
Superior constitutional courts exceptional cases में fair process secure करने के लिए further investigation, transfer of investigation या fresh/de novo investigation तक direct कर सकती हैं।
Requested form of investigation precise होनी चाहिए।
यह current statutory control old CrPC Section 173(8) में इसी express form में नहीं था।
Specific non-compliance पर current authority देखे बिना ninety-day direction को automatic acquittal या automatic exclusion rule में convert नहीं करना चाहिए।
Court को full record consider करके current stage की appropriate statutory procedure—जैसे discharge, alteration of charge, trial adjudication या कोई अन्य lawful order—use करनी होगी।
Section 193(9) ‘further report or reports’ contemplate
Magistrate के closure-acceptance order के विरुद्ध criminal revision उपलब्ध हो सकती है, subject to BNSS revisional provisions, limitation और maintainability।
यह decision हर pre-process police-report stage पर accused का universal participation right नहीं बनाता।
Later Supreme Court practice ने notice और legally available closure material तक access की आवश्यकता reiterate की है, subject to sensitive records से संबंधित lawful restrictions।
Same facts पर second complaint exceptional है और यह careful analysis चाहती है कि first proceeding क्यों समाप्त हुई और क्या genuinely new facts, evidence या legal error renewed process justify करते हैं।
Long unexplained delay discretionary reopening
यदि investigating या prosecuting authority Magistrate के order को legally erroneous मानती है, तो competent State authority available judicial remedy invoke कर सकती है।
POCSO, Prevention of Corruption Act, SC/ST Act, NDPS Act, PMLA
Current local filing rules, court nomenclature, certified-copy process, affidavit requirements, e-filing rules, language/translation requirements, police final-report classifications और relevant High Court circulars verify करें।
Transfer of investigation exceptional judicial remedy
Accepted closure के बाद long delay और executive reopening का combination भी close scrutiny चाहता है।
Closure acceptance same facts
Stage chart बनाएं: FIR → investigation → Section 193 report → notice → protest → Magistrate option → any further report/complaint cognizance → challenge।
Applicable procedural regime और savings position confirm करें; full police report और judicial orders obtain करें; verify करें कि informant को legally required hearing मिली; identify करें कि Magistrate ने police material या new protest evidence पर rely किया; complaint procedure को police-report cognizance से अलग रखें; और determine करें कि किसी further investigation के पास proper judicial authority है या नहीं।
फिर limitation, local filing rules, special-statute interaction, electronic/medical evidence preservation और exact remedy sought verify करें। File में uncertainties expressly state होनी चाहिए।
